VYTAL Application (iOS, Android, and Web)

These Terms of Use govern access to and use of the VYTAL application and associated services. Please read them together with our Privacy Policy.

1. Acceptance of the Terms

These Terms of Use ("Terms") govern access to and use of the VYTAL application and associated services ("Service"). By creating an account or using the Service, you declare that you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Who we are

The Service is provided by VYTAL MED HEALTH & WELLNESS CORP, a Florida company, USA (EIN 42-2398438), with its registered office at 8012 NW 68th St, Miami, FL 33166, USA ("VYTAL", "we", "us").

3. Description of the Service

VYTAL is a technology and wellness platform that provides tracking tools, educational content, AI assistants, and management of the VYTAL wellness program, including the guided tapering protocol. The clinical component — consultation, assessment, and prescription — is provided by independent licensed physicians and by telemedicine and pharmacy partners, under their own responsibility. The app may display the status of your order as reported by those partners.

4. Important medical notice

VYTAL does not provide medical care, and the content of the app does not constitute medical advice, diagnosis, or treatment. The AI assistants and educational materials are intended to support your wellness and do not replace evaluation by a qualified health professional. Always consult your physician before making health decisions, and never disregard or delay medical advice because of something you have read in the app. In an emergency, immediately contact your local emergency services.

5. Eligibility

The Service is intended for individuals aged 18 and over with the legal capacity to enter into contracts. By using the Service, you declare that you meet these requirements and provide truthful and up-to-date information.

6. User account

You are responsible for maintaining the confidentiality of your credentials and for all activity on your account;

You must provide accurate information, in particular health data, on which the safety of your monitoring depends;

You must notify us immediately of any unauthorized use of your account.

7. Artificial Intelligence assistants

The app includes AI assistants powered by third-party technology. Responses generated by AI may contain inaccuracies and do not replace professional medical, nutritional, or psychological advice. The mental wellness assistant is not psychotherapy and, when faced with signs of risk, points to support resources and refers you to human professionals. The use of the AI features is subject to the Privacy Policy.

8. Subscriptions, payments, and automatic renewal

Certain plans are paid by subscription, processed through Stripe or Iugu, depending on the market;

Subscriptions renew automatically at the end of each cycle (monthly, quarterly, or annual), charging the price then in effect, unless canceled before the renewal date;

You can cancel the renewal at any time; access continues until the end of the period already paid for, unless otherwise required by law;

The quarterly and annual plans are paid in advance, in a single payment;

Prices may be updated, with prior notice where required by law.

Recurring billing is automatic, but the renewal of any medical prescription always depends on review by a licensed physician and is not granted merely by the continuation of payment.

9. Referral program

The Service may include a referral program with benefits for you and for the person you refer, under the terms and conditions disclosed in the app, which we may change or suspend.

10. Intellectual property

The Service, including software, trademark, design, content, and materials, is the property of VYTAL or its licensors and is protected by law. We grant you a limited, personal, non-exclusive, and non-transferable license to use the app for personal and non-commercial purposes.

11. User content

You retain ownership of the content you submit (for example, photos and messages). You grant us a limited license to process it for the purpose of providing you with the Service. You are responsible for ensuring that you have the right to submit that content.

12. Acceptable use

You agree not to:

Use the Service for unlawful or unauthorized purposes;

Provide false information, in particular about age or health status;

Attempt to gain improper access to, interfere with, or compromise the security of the Service;

Resell, reproduce, or exploit the Service without authorization.

13. Limitation of liability

To the maximum extent permitted by law, the Service is provided "as is". VYTAL is not liable for indirect, incidental, or consequential damages arising from the use of the Service. Nothing in these Terms excludes liabilities that cannot be legally excluded, including mandatory consumer rights.

14. Termination

You can close your account at any time (see the Account Deletion page). We may suspend or terminate access in the event of a breach of these Terms or of the law.

15. Governing law and jurisdiction

These Terms are governed by the law of the State of Florida, USA, without prejudice to the mandatory consumer protection rules of your country of residence, which continue to apply. Depending on your country, you may resort to the courts and dispute resolution mechanisms of your jurisdiction.

16. Changes to the Terms

We may update these Terms. We will publish the updated version on this page and, where required, notify you. Continued use after the effective date implies acceptance.
